{"id":11836,"date":"2014-01-31T22:40:27","date_gmt":"2014-01-31T22:40:27","guid":{"rendered":"http:\/\/utel.mx\/blog\/?p=11836"},"modified":"2023-03-10T16:55:52","modified_gmt":"2023-03-10T16:55:52","slug":"derecho-empresarial-contrato-temporal-por-reconversion","status":"publish","type":"post","link":"https:\/\/utel.mx\/blog\/10-consejos-para\/derecho-empresarial-contrato-temporal-por-reconversion\/","title":{"rendered":"Derecho Empresarial: Contrato temporal por reconversi\u00f3n"},"content":{"rendered":"<p dir=\"ltr\">Dentro de la variedad de contratos posibles en el contexto corporativo del derecho empresarial, existen los llamados \u201ccontratos por reconversi\u00f3n empresarial\u201d, estos se llevan a cabo de acuerdo a la necesidad de cambio, sustituci\u00f3n, ampliaci\u00f3n o reestructuraci\u00f3n de los ejercicios desempe\u00f1ados por la empresa.<\/p>\n<p dir=\"ltr\">Estos involucran el espectro de car\u00e1cter tecnol\u00f3gico, d\u00edgase: maquinaria, equipos, instalaciones, medios de producci\u00f3n, sistemas, m\u00e9todos y procedimientos productivos y administrativos. Este tipo de contrato por su naturaleza \u201csemi-duradera\u201d tienen una vida m\u00e1xima de dos a\u00f1os.<\/p>\n<p dir=\"ltr\">Los contratos de reconversi\u00f3n pretenden fomentar la reorganizaci\u00f3n de los procesos corporativos, ata\u00f1en a una reforma tecnol\u00f3gica, siendo esta una actividad concerniente al derecho empresarial y para que sean sustanciales este tipo de contratos, deben ajustarse a la pol\u00edtica p\u00fablica intersectorial, en asuntos relacionados a la reducci\u00f3n de impuestos, importaci\u00f3n de maquinaria y capacitaci\u00f3n para encarar el proceso de reconversi\u00f3n.<\/p>\n<p dir=\"ltr\">El contrato por reconversi\u00f3n empresarial persigue elementalmente dos objetivos sustanciales, la primera se refiere a la reestructuraci\u00f3n de modelos anquilosados en los procesos de organizaci\u00f3n, producci\u00f3n y distribuci\u00f3n, es decir es de tipo tecnol\u00f3gico; la segunda compete a lineamientos estructurales, o sea la nueva organizaci\u00f3n de trabajo, qui\u00e9nes son los actores involucrados que liderar\u00e1n los cambios, la asunci\u00f3n de puestos nuevos y los nuevos dise\u00f1os para los puestos de trabajo requeridos.<\/p>\n<p dir=\"ltr\">Hay que apegarse siempre a modelos exitosos para llevar a cabo estos contratos, es decir no improvisar, as\u00ed como tomar en cuenta que el contexto de un pa\u00eds nada tiene que ver con el otro dentro del marco del derecho empresarial, de esta manera la capacitaci\u00f3n tiene que ser mayor y contar con expertos en la materia, de lo contrario puede haber fallos sustanciales que impacten negativamente en las empresas.<\/p>\n<p dir=\"ltr\">Los controles administrativos adquieren preponderancia, ya que estos deben responder a las expectativas y asumir con creces las nuevas competencias requeridas porque de ellos emana la responsabilidad de que el resto de los empleados se adapte r\u00e1pidamente a los cambios estructurales.<\/p>\n<p><strong>Adair
