{"id":2345,"date":"2013-08-07T18:39:24","date_gmt":"2013-08-07T18:39:24","guid":{"rendered":"http:\/\/utel.mx\/blog\/?p=2345"},"modified":"2023-03-10T16:52:31","modified_gmt":"2023-03-10T16:52:31","slug":"el-derecho-publico","status":"publish","type":"post","link":"https:\/\/utel.mx\/blog\/school-of-education\/el-derecho-publico\/","title":{"rendered":"El Derecho P\u00fablico"},"content":{"rendered":"<p><span style=\"color: #000000;\">El Derecho P\u00fablico es una rama del Derecho que tiene como objetivo regular los v\u00ednculos que se establecen entre los individuos y las entidades de car\u00e1cter privado y p\u00fablico, siempre y cuando estos act\u00faen bajo los lineamientos que la ley establezca.<\/span><\/p>\n<p><span style=\"color: #000000;\">La caracter\u00edstica del Derecho P\u00fablico, seg\u00fan Julio Rivera, prestigioso autor jur\u00eddico, es que sus mandatos no se encuentran sujetos a la autonom\u00eda de la voluntad que pudiesen ejercer las partes, son \u201cirrenunciables y obligatorios\u201d en virtud de ser mandados en una relaci\u00f3n de subordinaci\u00f3n por el Estado; regulan derechos que hacen al orden p\u00fablico y deben ser acatados por toda la poblaci\u00f3n.<\/span><\/p>\n<h2><span style=\"color: #000000;\">\u00bfA qui\u00e9n defiende el Derecho P\u00fablico?<\/span><\/h2>\n<p><span style=\"color: #000000;\">Defiende al individuo porque con \u00e9l se hace referencia a la existencia de una relaci\u00f3n desequilibrada entre este y el Estado, las normas persiguen la consecuci\u00f3n de un<b>&nbsp;<\/b>inter\u00e9s p\u00fablico, la seguridad jur\u00eddica est\u00e1 dada por el&nbsp;principio de legalidad que implica que el ejercicio de las potestades debe sustentarse en normas jur\u00eddicas determinadas por un \u00f3rgano competente y por las materias que se encuentran bajo su jurisdicci\u00f3n.<\/span><\/p>\n<h3><span style=\"color: #000000;\">\u00c9ste a su vez se divide en distintas ramas que son:<\/span><\/h3>\n<ul>\n<li><span style=\"color: #000000;\">Derecho constitucional: Comprende el conjunto de normas e instituciones jur\u00eddicas fundamentales relativas a la organizaci\u00f3n y al ejercicio del poder pol\u00edtico y a los derechos y libertades b\u00e1sicas de los ciudadanos.<\/span><\/li>\n<li><span style=\"color: #000000;\">Derecho administrativo: Regula la organizaci\u00f3n y el funcionamiento de los poderes y \u00f3rganos del Estado, as\u00ed como sus relaciones con entidades particulares.<\/span><\/li>\n<li><span style=\"color: #000000;\">Derecho penal: Regula la actividad punitiva del Estado.
